These terms apply to your use of the HEAR app. Subscriptions are also subject to Apple’s terms – when you buy through the App Store, the purchase contract is with Apple, not with us.
2. What HEAR is – and what it is not
HEAR is a conversation ritual for couples. The app gives you a structure, sentence starters and a clock. What you say to each other is up to you.
HEAR is not therapy and does not replace it. It is not medical, psychological or legal advice, not a diagnosis and not a treatment. We do not guide your conversation and we do not read along.
HEAR is not an emergency service. If you are in crisis, if there is violence, or if someone is in danger, please do not use this app – get help. In the EU, call 112. In Germany, Telefonseelsorge on 0800 111 0 111. In the Netherlands, 113 Suicide Prevention on 113 or 0800 0113. Elsewhere, contact your local emergency number.
If a conversation becomes too much, stop. The app has an exit at every point, and taking it is not a failure.
3. Using the app
You may use HEAR if you are at least 16 years old.
HEAR is built for one device and two people: you sit together and pass the phone. You decide together who speaks when and what you enter.
You are responsible for what you say to each other and write into the app. Do not use HEAR to pressure, control, or push another person into a conversation they do not want.
4. Your data
HEAR keeps everything on your device only. There is no account, no sign-in, and no server of ours. We do not see what you enter, nor whether or how often you use the app. If you delete the app, the data is gone – with no backup, including on our side.
If you write to us through the feedback form, the app opens an email in your mail program. You see what it says, and you send it – not the app.
Details are in our privacy policy.
5. Free and subscription
One small round stays free, always, as often as you like. You may go through the full ritual once before you decide.
Everything else is part of the subscription. Price, duration and renewal are shown in the app before you buy. The subscription renews automatically until you cancel.
Purchase, renewal, cancellation and refunds all go through Apple – in your device settings, under your Apple Account. We cannot view, end, or refund a subscription. Your rights towards Apple, including any statutory right of withdrawal, are unaffected.
6. Content in the app
The texts, sentence starters, articles, design and illustrations in HEAR belong to us or to our licensors. You may use them privately – in your conversations, in your notes, in your life. You may not reproduce them, distribute them publicly, or include them in your own offering.
What you write into the app is yours. It stays on your device.
7. Availability and changes
We keep developing HEAR. Features may be added, changed, or removed. We cannot promise that the app will run without fault at all times and on every device.
If we make a material change to these terms, we will say so in the app before it takes effect.
8. Liability
We are fully liable for intent and gross negligence, and for harm to life, body or health. For slight negligence we are liable only for breach of an essential obligation – one that makes proper use possible in the first place – and limited to the foreseeable, typical damage at the time the contract was made. Otherwise liability is excluded. Mandatory consumer protection law remains unaffected.
We are not liable for decisions you make on the basis of your conversations. HEAR gives no advice and makes no recommendation about your relationship.
9. Governing law
German law applies. If you are a consumer, the mandatory protective provisions of your country of residence remain unaffected.
